For parents

1. What should my child tell a teacher who makes racially defamatory statements?
“It is unlawful discriminate against me, or my viewpoint based on my race, heritage or national origin.”
“What you are saying about Turkish people is false and violates federal civil rights law”

2. What should I do if my child reports being taught anti-Turkish racial content at school?
Get the materials, document everything in writing, file a formal complaint with the school and the Department of Education’s Office for Civil Rights, and contact TADA immediately or your attorney — every day of delay weakens your legal position.

3. Can we sue a school for teaching racially defamatory curriculum?
Yes — Title VI of the Civil Rights Act prohibits race and ancestry-based discrimination in any school receiving federal funding, and curriculum that stigmatizes Turkish-American students can be challenged in court and with the Department of Education.

4. Can we sue school districts for adding racially defamatory teaching material to their curriculum?
Yes — parents can sue school district officials over curriculum that violates federal civil rights law, and can also file a complaint with the Department of Education’s Office for Civil Rights.

5. What type of attorney do I need?
An attorney experienced in constitutional law and federal civil rights litigation — contact TADA for a referral.

6. What evidence do I need to file a lawsuit against a racial defamer?
You need the original false statement (screenshot, recording, or document), proof that others saw or heard it, evidence linking it specifically to you, and documentation of the harm it caused — gather it immediately before it disappears.

7. What do I need to know about the lawsuit processes?
Every defendant is presumed innocent until proven guilty beyond a reasonable doubt with trappings of due process; the burden of proof is on you; time limits to file are strict (often one to three years); and civil and criminal cases can run at the same time. Please contact TADA or your attorney for further information and support.
